The most serious legal problem (and not just legal) that the planning lawhas to face is always to ensure the neutrality of planning as regards the regimeof soils (and therefore their exchange value). In this context, in recent decades,a new interest in urban equalization has established in Italy: it allowed areinterpretation and application of this principle in a much more extensive andvaried way than that, very weak, required by the National Development PlanningAct of 1942.Regional institutions have provided an initial response to this new planningdemand, realizing the necessity of having to provide greater flexibility in themanagement of the territorial government.This article, in particular, is a careful examination of the interpretation ofthe equalization principle that is required by the Planning Act of Calabria, inorder to verify its efficacy and overcome any critical elements.

El principal problema legal (y no sólo legal) que el derecho urbanísticosiempre ha tenido que afrontar es garantizar la neutralidad de la planificaciónrespecto al régimen del suelo (y por tanto su valor de cambio). En este contexto,en las últimas décadas en Italia se ha ido consolidando un nuevo interés porel reparto equitativo urbanístico que ha permitido una relectura y una aplicaciónmás extensa y diversa del mismo, muy superficial, previsto por la Ley UrbanísticaNacional de 1942 (Legge Urbanistica Nazionale del 1942).A esta nueva cuestión sobre planificación han dado respuesta, sobretodo, lasinstituciones regionales que han intuido la necesidad de tener que proporcionaruna mayor flexibilidad en la gestión del gobierno territorial.Este artículo, en particular, constituye un examen meticuloso de la interpretacióndel principio de reparto equitativo previsto en la Ley de PlanificaciónUrbanística de Calabria (Legge Urbanistica della Calabria), con la finalidad deverificar su eficacia y superar los elementos críticos que puedan acaecer.
