The paper, starting from the analysis of the normative, historical and dogmatic evolution of the agent provocateur, intends to highlight the differences between this figure and the one of the undercover agent. The work focuses, in particular, on the problem of the criminal responsibility of the agent provocateur and examines the developments of the new national legislation that introduces undercover operations in the field of crimes against the Public Administration. In conclusion, the article illustrates – in a comparative key – the regulations of undercover operations in the Italian and American legal systems.
