In this article, we will analyze the increasing importance of the penal response in relation to changes in power structures within our society. We will examine this process starting from the weakness of the regulatory function of the nation-state. The nation-state has become the guarantor of social order, whether through its location within a given international geopolitical sphere or through the maintenance of law and order internally. These are two essential conditions imposed by processes of globalization. Maintaining internal order involves implementing security management policies and disseminating within the population elements invoking slogans such as zero tolerance for crime and the introduction of new offenses which, rather than sanctioning behaviors, aim to identify socially constructed categories as dangerous.
